MyLA Terms of Use

INTRODUCTION

The following Terms of Use (“Terms”) govern your access to and use of the MyLA website and portal (collectively, the “Website”), its services, and affiliated services, as well as all information and materials available on this Website (collectively, the “Content”). The Website is developed, owned, and operated by the Office of Technology Services, Division of Administration, State of Louisiana (“State”), for the convenience of its citizens and other authorized users.

By accessing or using the Website in any capacity, you (the "User") expressly acknowledge and agree to be bound by these Terms. If you do not accept these Terms, you are not authorized to access or use the Website. The State reserves the right to modify, amend, or update these Terms at any time without prior notice, and your continued use of the Website following any modification constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically to ensure continued compliance.

OWNERSHIP AND ADMINISTRATION

The Website and all associated content, interfaces, and underlying technologies are the property of the State. The Office of Technology Services, which is responsible for the Website’s maintenance and operation (collectively referred to herein as the “State” or “we”), exercises full administrative control over its content, structure, and functionality. Any external links, references, or third-party integrations provided through the Website are offered solely as a convenience and do not imply endorsement or control by the Office of Technology Services or the Division of Administration, which disclaims any liability for external content or services outside the scope of the Website.

USER ACCOUNTS AND RESPONSIBILITIES

Eligibility and Registration

You may be required to register and create a user account to access certain features of the Website. By registering for an account, you represent and warrant that all information you provide is truthful, accurate, current, and complete. You further agree to update your account details if they change to maintain their accuracy. The State relies on this information to provide governmental services, and inaccurate information may affect your ability to access such services.

Security and Confidentiality

You are solely responsible for maintaining the confidentiality of your account credentials (including, without limitation, your username and password). You agree to notify the State immediately of any known or suspected unauthorized use of your account or any other breach of security relating to the Website. The State shall not be liable for any losses or damages arising from unauthorized use of your credentials.

Accuracy of Personal Information

You acknowledge that your account data, including name, email, address, phone number, and any other identifying information, may be used to facilitate official communications and service delivery by Louisiana government agencies. Accordingly, you agree to maintain accurate and updated information in your Website account at all times.

If you become aware of any unauthorized use of your password or your account, you agree to notify the State immediately by visiting the Website’s help page for password services. You may be required to provide details of the unauthorized access to assist with investigation and resolution.

PROHIBITED USE

Your access to and use of this Website and the Content may be terminated at any time without notice if you engage in prohibited activities. You agree to access and use this Website only for lawful purposes. You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules, and regulations pertaining to your use of this Website. By accessing this Website, you agree that you will not:

  1. Use this Website to commit a criminal offense or to encourage others to engage in any conduct which would constitute a criminal offense;

  11. Misrepresent the Content or this Website, or misinform others about the origin or ownership of the Content or this Website.

The State reserves the right to suspend any Website account and/or suspend access to this Website if the State has reason to believe that the account/access is being used for any of the prohibited purposes enumerated in this section. The State shall provide notice of such suspension if you have provided the State with an email or other electronic address or mail address when accessing the Website.

PRIVACY AND DATA USE

Collection of Personal Information

The Website may collect certain personally identifiable information ("PII") from you, including, but not limited to, your name, email address, telephone number, mailing address, and other data necessary for account creation or service provision. By submitting such information, you consent to the collection, use, and disclosure of your PII in accordance with applicable federal, state, and local laws, as well as any specific Website or State privacy policies.

Use and Disclosure

The State shall use the information you provide to facilitate your access to and use of State-provided online services, improve Website functionality, and verify your identity where required. The State may share your information with affiliated State of Louisiana agencies for the purpose of providing the services or functions at your request.

You acknowledge that any information submitted to the Website may be subject to public disclosure pursuant to the Louisiana Public Records Law (La. R.S. 44:1 et seq.) or other legal requirements, unless specifically exempted by statute or regulation. The State shall make reasonable efforts to maintain confidentiality where legally required, but makes no guarantee of absolute privacy.

EMAIL AND NOTIFICATIONS

Transactional Communications

By creating an account or otherwise providing your email address, you consent to receive transactional emails from the State regarding account status, password resets, verification codes, and other service-related notifications (collectively, “Automated Emails”).

Service Announcements

The State may also distribute important announcements related to Website modifications, security alerts, or policy updates. Such notices are vital to the functionality of the Website and may be delivered via email or posted within the Website.

SECURITY MEASURES

User Responsibility

You are responsible for ensuring that your devices and networks are secure, that you maintain strong, updated passwords, and that you guard against unauthorized access to your personal information. The State implements reasonable security measures to protect the Website, but cannot guarantee that unauthorized third parties will never be able to defeat these measures.

LINKING AND EXTERNAL LINKING

Websites owned and maintained by the State may include hyperlinks to third-party sites, such as social media, other state entities outside the authority of the Division of Administration, or file-sharing sites. When you access these external sites, you are subject to another entity‘s terms of use and privacy/security policies, which we recommend you review. The State is not responsible for the accuracy, completeness, legality, practices, or availability of linked sites (including any related services, content, software applications, and other technologies).

In addition, the State is not responsible for any interruption of services, malfunctions, or security breaches involving these third-party sites. References or links to any services or the use of any trade, firm, or corporation name do not constitute endorsement by the State. The State reserves the right to remove any link at any time.

LANGUAGE TRANSLATIONS

This Website has been translated into limited languages for your convenience. Translations may be inaccurate, incomplete, or unreliable. The translations are provided “as is” without warranties of any kind. Some content (such as images, videos, Flash, etc.) may not be able to be translated accurately (or translated at all). The State is not responsible for incomplete or inaccurate translations, nor is it liable for any damages or losses arising out of the user‘s use of this Website‘s translation.

In all instances, the English version of the Website and all related content, including these Terms, shall be controlling. If there is any conflict between the English version and a translated version, the English version shall prevail.

Third-party Translation Services

The State of Louisiana does not endorse any third-party translation services or tools (such as browser translation features) that users may employ to translate this Website. The State is not responsible for incomplete or inaccurate translations by third-party services, nor is it liable for any damages or losses arising out of the user's use of third-party translation services. All warranties related to third-party translations, express or implied, including any warranties of accuracy, and fitness for a particular purpose, are hereby disclaimed.

CHANGES TO THE WEBSITE

Modifications and Enhancements

The State may, at its sole discretion and without prior notice, modify, enhance, or discontinue any aspect or feature of the Website. Such modifications may include, but are not limited to, the addition or removal of functionalities, reorganization of content, or alterations to user interface components.

User Data Preservation

While the State aims to maintain the continuity of user account data and configurations during Website updates, it does not guarantee uninterrupted access to any particular service or feature. Any downtime or data unavailability resulting from necessary system maintenance or upgrades shall not constitute a breach of these Terms.

FEEDBACK

Feedback. Authorized Users may provide Feedback to the State. The State may use that Feedback without restriction and without obligation to You or Authorized Users.

If you submit to the State suggestions or other feedback related to the Website, the State owns all rights to the feedback and may use the feedback for any purpose without compensation to you or any other person and without any obligation of confidentiality to you.

DISCLAIMERS AND LIMITATION OF LIABILITY

No Warranty

The Website and the Content are provided on an “as is,” “as available” basis, and may be subject to errors, inaccuracies, or omissions. The State, and its officials, officers, employees, contractors, and agents (collectively, the “State Entities”) make no representations or warranties regarding this Website or the Content, including but not limited to their completeness, accuracy, timeliness, non-infringement of third-party rights, or freedom from computer viruses.

Your access to and use of this Website and its Content are at your sole risk. The State Entities are not responsible for any damages (including but not limited to any direct, indirect, incidental, special, consequential, or exemplary damages), losses, claims, or liability, known or unknown (including, but not limited to loss of profits, goodwill, use, or data), arising out of the use of (or inability to use) this Website, the Content, any third-party site linked to this Website, or any error, omission, interruption, defect, delay, computer virus, theft, destruction, damage to computer systems, or unauthorized access.

Government Immunity

Nothing in these Terms is intended to limit or waive any sovereign or other governmental immunities applicable to the State, its agencies, officers, or employees under Louisiana law, including but not limited to those immunities provided under La. R.S. 9:2798.1 and La. R.S. 13:5101 et seq.

Exclusion of Damages

Under no circumstances shall the State be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits or lost data, arising out of or in connection with your use or inability to use the Website.

Maximum Extent of Law

These limitations shall apply to the fullest extent allowed by law, regardless of the form of action, whether in contract, tort (including negligence), or otherwise.

INDEMNIFICATION

User Agreement to Indemnify

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless the State, its agencies, officers, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  1. Your breach of these Terms;
  2. Your violation of any applicable law or regulation; or
  3. Your misuse of the Website.

Cooperation

You further agree to cooperate fully in the defense of any such claim. The State reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with the State in asserting any available defenses.

INTELLECTUAL PROPERTY RIGHTS

All content, features, and functionality of the Website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by the State or its content suppliers and are protected by United States and international copyright laws.

The compilation of all content on the Website is the exclusive property of the State and is protected by United States and international copyright laws. All software used on the Website is the property of the State or its software suppliers and is protected by United States and international copyright laws.

The State name, the term “MyLA,” all related names, logos, product and service names, designs, and slogans are trademarks of the State. You may not use such marks without the prior written permission of the State.

TERMINATION OF USE

State’s Right to Terminate

The State reserves the right, at any time and for any lawful reason or no reason, to terminate or suspend your access to the Website, in whole or in part, without prior notice. Grounds for termination may include, but are not limited to, a breach or violation of these Terms or any applicable legal obligations.

Effect of Termination

Termination or suspension of access may include the deactivation or deletion of your account and the forfeiture of any data or content associated with your use of the Website. The State shall not be liable to you or any third party for any termination of your access to the Website.

SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms. The remaining provisions shall remain in full force and effect.

In the event a provision is declared void or unenforceable, the parties agree that the court may modify the provision to the minimum extent necessary to render it valid and enforceable, consistent with the intent of the parties.
